Professional Liability Insurance

Coverage area: worldwide;

except for liability arising from
- services rendered through law firms or offices established or maintained in other countries,
- advice or services rendered on non-European law, or
- services rendered by our attorneys before non-European courts. For liability arising from services rendered by our attorneys before non-European courts, insurance coverage is available only in the minimum amount required by law. The provisions of § 4 no. 1 and § 16 (IV) of the General Terms and Conditions of Insurance for Third-Party Liability Insurance for Financial Damages (AVB-A) and § 51 (III) nos. 2-4 of the Federal Attorney's Act (BRAO) apply.

According to the Partnership Act, the personal liability of the partners for obligations of the partnership is limited. Only those partners who have been involved in a certain matter may be personally liable with respect to that matter. Partners whose contributions to the matter were minor are not personally liable with respect to that matter. For details of a partner's professional liability, please refer to Sec. 8 of the German Partnership Act.

 

Mediation
Any disputes between attorneys and their clients may be referred to mediation before a local office (Hamburg or Berlin) of the German Bar Association office (Bundesrechtsanwaltskammer) under Sec. 73 II no. 3 in conjunction with Sec. 73 V of the Federal Attorneys’ Act (BRAO), or before the mediation board for attorneys of the German Bar Association (Bundesrechtsanwaltskammer) under Sec. 191 f of the Federal Attorneys’ Act (BRAO). The German Bar Association (Bundesrechtsanwaltskammer) can be found on the Internet at www.brak.de. The mediation board can be contacted by e-mail at schlichtungsstelle@brak.de.
